Terms of Service

1. Overview

These Terms of Service govern your access to and use of Orbits, an AI-native workspace for marketing agencies that helps teams import client inputs, preserve client context, generate client-ready artifacts, reports, summaries, previews, and shared links, and manage related workspace activity. By using Orbits, creating an account, starting a checkout, or accessing a demo or integration setup flow, you agree to these Terms.

2. Beta and Early Access

Orbits is currently in an early-stage beta. Features, integrations, reports, alerts, pricing, limits, and availability may change as the product develops. Some pages may use sample data or sandbox/test-mode integrations for demonstration purposes.

3. API Access and Beta Partners

Orbits may offer early API access to select partners, collaborators, or beta users. Any such API access is provided on an "as is" and "as available" basis and may be designated as beta, preview, or early access.

  • endpoints, response formats, authentication methods, and data models may change at any time, with or without notice;
  • breaking changes may occur between versions;
  • Orbits may modify, suspend, limit, or discontinue API access at any time;
  • Orbits does not guarantee advance notice of changes, continued backward compatibility, or uninterrupted availability; and
  • API beta access does not include any service level agreement, uptime commitment, or support obligation unless explicitly agreed in writing.

Any partner pricing, beta pricing, or collaborator access terms agreed separately govern commercial access only and do not guarantee feature availability, API stability, or continued access beyond the agreed term.

By using the API under beta, preview, partner, or collaborator access, you acknowledge and accept these limitations.

4. Accounts and Access

You are responsible for maintaining the security of your account and any credentials, webhook URLs, API keys, or integration permissions you provide. You may not use Orbits to access systems, data, or accounts that you are not authorized to use.

5. Integrations and Customer Data

Orbits may connect to third-party services such as GitHub, Slack, Stripe, uptime providers, or other tools you choose to connect. You are responsible for ensuring that you have the right to connect those services and share the relevant data with Orbits. Third-party services remain governed by their own terms and policies.

You retain ownership of content and data you upload, paste, import, connect, or create in Orbits. You grant Orbits the rights needed to host, process, transform, display, generate outputs from, and transmit that content solely to provide, secure, support, and improve the service and operate the integrations you enable.

6. AI Outputs, Reports, and Recommendations

Orbits may generate reports, summaries, insights, recommendations, creative drafts, previews, and other artifacts using customer-provided data, third-party integrations, deterministic rendering, and AI systems. These outputs are informational drafts and may be incomplete, delayed, inaccurate, or based on limited or stale data. You are responsible for reviewing outputs before sharing them with clients or using them for business, financial, legal, advertising, or operational decisions.

Orbits does not provide legal, financial, tax, accounting, advertising compliance, or other professional advice. You are responsible for ensuring your client communications, claims, reports, recommendations, and use of generated outputs comply with applicable laws, platform policies, and client agreements.

7. Upload-Based Image Tools

Some Orbits tools may let you upload images for cleanup, formatting, mockups, covers, or other generated visual outputs. You may only use upload-based image tools if you are 18 or older. You may not upload images of minors, images of people without their permission, or images containing explicit, illegal, hateful, deceptive, or harmful content.

You confirm that you own or have the rights and permissions needed to upload and use any image or asset you provide. Uploads and generated image outputs may be temporarily processed and stored to provide the requested tool result, then deleted within the retention window shown in the product. Generated image outputs are drafts and are not guaranteed to be accurate, professional, compliant, or suitable for every use.

You may not use Orbits image tools to impersonate others, mislead viewers, violate privacy or publicity rights, create deceptive business materials, or produce harmful or unlawful content.

8. Payments, Subscriptions, and Usage

Paid plans are billed through Stripe. Subscription pricing, plan limits, billing periods, and available features are shown at checkout or on the pricing page. Unless otherwise stated, subscriptions renew automatically until cancelled. Taxes may apply.

Some features consume AI credits, usage allowances, or other plan limits. Credit estimates may differ from actual usage. Orbits may meter, limit, throttle, or suspend usage to prevent abuse, manage costs, or enforce plan limits.

9. Acceptable Use

You may not misuse Orbits, interfere with the service, attempt unauthorized access, reverse engineer the service, use it to violate laws or third-party rights, or submit malicious, deceptive, or harmful content or traffic.

You may not use Orbits if you are located in, ordinarily resident in, organized under the laws of, or acting on behalf of any country, region, person, or entity subject to comprehensive sanctions, embargoes, export controls, or other trade restrictions under applicable law, including restrictions administered by the United States, Canada, the United Kingdom, the European Union, or the United Nations.

You may not use Orbits to provide services to, process data for, or facilitate transactions involving sanctioned persons, restricted parties, or prohibited jurisdictions. Orbits may restrict, suspend, or terminate access where required by law or where we reasonably believe use may violate sanctions, export control, or trade compliance obligations.

10. Availability and Changes

Orbits may change, suspend, or discontinue parts of the service at any time. We aim to provide a reliable service, but we do not guarantee uninterrupted availability, perfect accuracy, or compatibility with every third-party integration.

11. Limitation of Liability

To the maximum extent permitted by law, Orbits will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunities arising from your use of the service.

12. Indemnity

You agree to defend, indemnify, and hold Orbits harmless from claims, damages, liabilities, and expenses arising from your content, your client communications, your integrations, your use of the service, or your violation of these Terms or applicable law.
